By accessing and using InCash, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. InCash reserves the right to update and change the Terms of Use from time to time without notice.
2. Service Description
InCash is an investment portfolio management platform that provides users with the ability to:
- Create and manage investment portfolios
- Access daily investment returns
- Withdraw earnings through M-Pesa and other payment methods
- Track investment performance and analytics
- Participate in referral programs for additional income
- View investment package details and terms
3. User Responsibilities
As a user of InCash, you agree to:
- Provide accurate, complete, and truthful information during registration
- Maintain the confidentiality of your account credentials
- Not share your password or account access with others
- Use the platform only for lawful purposes and in accordance with these Terms
- Not engage in any activity that could compromise the platform's security
- Be responsible for all activities that occur under your account
- Comply with all applicable local, state, national, and international laws and regulations
4. Investment Risks and Disclaimers
InCash provides investment portfolio management services. Please understand and acknowledge the following:
- All investments carry inherent risks including potential loss of principal
- Past performance does not guarantee future results
- Investment returns are not guaranteed and may vary based on market conditions
- You are responsible for understanding your investment choices
- InCash does not provide personalized investment advice
- You should consult with a financial advisor before making investment decisions
5. Account Termination
InCash reserves the right to suspend or terminate your account if:
- You violate these Terms of Use
- You engage in fraudulent or illegal activities
- You provide false or misleading information
- Your account shows signs of suspicious activity
- You breach any applicable laws or regulations
6. Limitation of Liability
To the fullest extent permitted by law, InCash and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the platform, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
7. Indemnification
You agree to indemnify, defend, and hold harmless InCash and its officers, directors, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses arising from your violation of these Terms or any applicable law or regulation.
8. Intellectual Property Rights
All content, features, and functionality of the InCash platform, including but not limited to text, graphics, logos, and software, are the exclusive property of InCash and are protected by international copyright, trademark, and other intellectual property laws.
9. Payment and Withdrawal Terms
- All transactions are processed through secure payment gateways
- M-Pesa withdrawals are subject to M-Pesa terms and conditions
- Processing times may vary based on payment method and banking institutions
- InCash is not responsible for delays caused by third-party payment processors
- A minimum withdrawal period of 30 minutes applies after investment initiation
- Withdrawal amounts must meet minimum requirements specified in the platform
10. Referral Program
The InCash referral program allows users to earn bonuses by inviting friends. Terms include:
- Referral bonuses are credited based on successful referred investments
- Bonus amounts are specified in the referral program details
- Fraudulent referrals will result in account suspension and bonus forfeiture
- InCash reserves the right to modify referral terms with notice
11. Dispute Resolution
Any disputes arising from your use of InCash shall be resolved through:
- Good faith negotiation between parties
- Mediation if negotiation fails
- Binding arbitration as a final resolution method
12. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Kenya, and you irrevocably submit to the exclusive jurisdiction of the courts located in Kenya.
